New tariff benefits under the EU-Ukraine Association Agreement

The Official Journal of the European Union (OJEU) has published Decision No. 3/2025 of the EU-Ukraine Association Committee in its Trade configuration, dated 14 October 2025, concerning the reduction and elimination of customs duties pursuant to Article 29(4) of the Association Agreement between the European Union, the European Atomic Energy Community and their Member States, on the one part, and Ukraine, on the other part.

The Decision, which enters into force on 4 November 2025, provides for the reduction or elimination of additional customs duties currently applied to goods originating in either the EU or Ukraine. It also foresees the alignment of Ukrainian legislation with the legal acts of the European Union.  In addition, the Decision allows each Party— and, in the case of the Union, one or more Member States— to adopt safeguard measures if these additional tariff benefits are found to cause economic, social, or environmental harm. To benefit from these tariff reductions, traders must comply with the rules of origin established in the EU-Ukraine Association Agreement, as currently applied.

The Decision, which will be reviewed in 2028, comprises the following sections:

  • Appendix A of Annex I-E, containing the tariff schedules for products originating in the EU when imported into Ukraine (Ukrainian tariff list) and for products originating in Ukraine when imported into the EU (EU tariff list).  Both lists set out the tariff reductions applicable from the date of entry into force of the Decision and subsequently from 1 January of each following year. Goods originating in either the EU or Ukraine that do not appear in these lists shall be exempt from customs duties when imported into the other Party.
  • Appendix B of Annex I-E, providing a summary of the aggregate quantities indicated in Appendix A, and divided into two sections:
    • Section A: Tariff quotas for imports into the EU.
    • Section B: Tariff quotas for imports into Ukraine.
    • For 2025, the quotas will amount to seven-twelfths of the revised quantities.
  • Appendix C of Annex I-E, listing the production standards that Ukraine must adapt to align with EU requirements.
