The Economic Partnership Agreement between the EU and Kenya entered into force on 1 July 2024, with the aim of boosting bilateral trade and encouraging investment in the country.
The tariff liberalisation provided for in the agreement is not equal for both Parties. Access to the EU market is liberalised from the Agreement entering into force, so that products originating in Kenya, except arms, can be imported into the EU without tariffs or quotas. For its part, Kenya will open its market to EU imports in different stages over 25 years, excluding sensitive products.
On a transitional basis, the rules of origin included in Regulation (EU) 2016/1076 of the European Parliament and of the Council (Market Access Regulation) apply. On this basis, the proof of origin to be presented at the time of release for free circulation to benefit from the tariff advantage established by the Agreement will be the EUR 1 movement certificate, or the invoice declaration issued by an approved exporter. For shipments equal to or less than €6,000, the invoice declaration may be made by any exporter.
The future origin protocol will be based on the Economic Partnership Agreement between the EU and the East African Community and will be adopted by both Parties within five years after the date the Agreement enters into force. This period may be extended.
