On 28 July 2025, the Commission Implementing Regulation (EU) 2025/1505 of 25 July 2025 was published in the Official Journal of the European Union (OJEU). This Regulation imposes definitive anti-dumping duties and confirms the collection of the provisional duties previously applied on imports of epoxy resins originating from the People’s Republic of China, Taiwan and Thailand. It also formally closes the investigation concerning imports of epoxy resins from the Republic of Korea.
In accordance with this Regulation:
- A definitive anti-dumping duty has been imposed on imports of products containing more than 35% by weight of epoxy resins (also known as epoxide resins or polyepoxides). These are polymers or prepolymers containing reactive epoxy groups, based on epichlorohydrin and an aliphatic or aromatic alcohol component (such as BPA). They may be in solid, semi-solid or liquid form, of any grade, purity, molecular weight or molecular structure, and may contain modifiers, curing agents or additives, provided that the curing agents have not chemically reacted to cure the epoxy resin or transform it into a distinct product that no longer contains epoxy groups. These products currently fall under CN codes ex 2910 90 00, ex 3824 99 92, ex 3824 99 93 and ex 3907 30 00 (TARIC codes 2910 90 00 05, 3824 99 92 96, 3824 99 93 10, 3907 30 00 05, 3907 30 00 20 and 3907 30 00 80) and originate from the People’s Republic of China, Taiwan and Thailand.
- The general anti-dumping duty rates are 33.0% for products originating from China, 11.0% for those from Taiwan and 29.9% for those from Thailand. However, individual rates may apply to certain companies, as specified in paragraph 2 of Article 1.
- The application of individual duty rates is conditional upon the submission, at the time of release for free circulation, of a valid commercial invoice that includes a dated and signed declaration by a responsible official of the issuing company, clearly stating their name and position, with the following wording: “The undersigned certifies that the (volume in the corresponding unit) of (product concerned) sold for export to the European Union and listed on this invoice was manufactured by (name and address of the company) (additional TARIC code) in (country concerned). The undersigned also declares that the information contained in this invoice is complete and accurate.” It also declares that the information provided in this invoice is complete and correct. Until this invoice is presented, the duty applicable to all other imports originating from the relevant country will apply.
- The amounts already collected under the provisional anti-dumping duties imposed by Implementing Regulation (EU) 2025/393 on imports of epoxy resins originating from the People’s Republic of China, Taiwan and Thailand will be definitively retained. Any amounts collected that exceed the final anti-dumping duty rates will be refunded.
- The Regulation also allows for the possible inclusion of new exporting producers from the People’s Republic of China. Such producers would then be subject to the weighted average anti-dumping duty rate applicable to cooperating companies that were not part of the sample during the investigation period. To qualify, they must provide the evidence outlined in Article 3.
- As the investigation concluded that imports from Korea were not subject to dumping, the proceeding concerning imports from that country has been terminated.
